LAS INSTITUCIONES DEMOCRÁTICAS A PRUEBA DE POPULISMO: UNA REFLEXIÓN SOBRE LAS PROTESTAS CHILENAS

Resumen

The social conflicts in Latin America and in the rest of the world remind
us of the extent to which legal and institutional forms sacrifice interests
and forms of life, producing painful inequalities and conflicts, and revealing once again the paradoxical and ambivalent nature of law, the order
of which is profoundly and constitutively embedded in the dimension of
power. The Roman concept of fictio legis can perhaps help to visualize this
delicate dynamic, in order to avoid a hypostatization of the historically
achieved institutional order
